Terms of Service

These Terms of Service ("Terms") govern your use of the PetBet mobile application and website (the "Service"), operated by AdiaX LLC ("AdiaX," "we," "us," or "our"). By creating an account or using PetBet, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to create a PetBet account. If you are between 16 and the age of legal majority in your jurisdiction, you confirm you have a parent or guardian's permission to use the Service and agree to these Terms.

2. The Service

PetBet uses artificial intelligence to estimate a pet's breed, age, and mood from a photo, provide general guidance through "Virtual Vet" based on described symptoms, and operate a Lost Pet Registry to help reunite lost pets with their owners.

2.1 AI estimates are not guarantees

Breed, age, and mood results are AI-generated estimates based on visual analysis. They are not verified by a professional and may be inaccurate, particularly for mixed breeds. Do not rely on these estimates for medical, legal, breed-registration, or insurance purposes.

2.2 Virtual Vet is not veterinary care

Virtual Vet does not provide veterinary, medical, or emergency advice, and is not a substitute for examination, diagnosis, or treatment by a licensed veterinarian. It is intended to help you understand general possibilities and decide whether to seek professional care. If your pet is showing signs of a medical emergency, contact a licensed veterinarian or emergency animal hospital immediately — do not rely on PetBet.

2.3 Lost Pet Registry

The Lost Pet Registry compares photos submitted by a finder against your registered pet using AI visual matching. We do not guarantee a match will be found, that a match is accurate, or that your pet will be recovered. You are responsible for keeping your contact information current so a finder's notification reaches you.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at petbetapp@gmail.com if you suspect unauthorized access.

4. Free Tier, Trial, and Subscriptions

• Free tier: the free version of PetBet includes a limited number of analyses per day, as displayed in the app.
• Free trial: new subscribers may receive a 14-day free trial of PetBet Premium. Unless cancelled before the trial ends, the trial will automatically convert to a paid subscription and your payment method will be charged.
• Subscription plans: PetBet Premium is currently offered at $5/month or $40/year, billed in advance on a recurring basis until cancelled.
• Cancellation: you may cancel your subscription at any time through the app or your app store account settings. Cancellation takes effect at the end of the current billing period; we do not provide prorated refunds for partial periods except where required by law.
• Price changes: we may change subscription pricing with advance notice; changes apply to your next billing cycle at the earliest.

Payments are processed by Stripe. By subscribing, you also agree to Stripe's applicable terms governing the payment transaction.

5. Acceptable Use

You agree not to:

• Upload photos that are not of animals, that are illegal, abusive, sexually explicit, or that infringe someone else's rights;
• Submit false information to the Lost Pet Registry, including registering a pet that is not lost or that is not yours;
• Attempt to circumvent free-tier limits through multiple accounts, automation, or other abuse;
• Reverse-engineer, scrape, or interfere with the Service or its underlying AI systems;
• Use the Service in any way that violates applicable law.

We may suspend or terminate accounts that violate these Terms.

6. Intellectual Property

PetBet, its logo, and its software are owned by AdiaX LLC and protected by intellectual property laws. You retain ownership of the photos you upload, but grant AdiaX a limited license to process and store them as needed to provide the Service (including, where applicable, sharing a matched photo with a finder through the Lost Pet Registry).

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF AI-GENERATED RESULTS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY AI ANALYSIS WILL BE ACCURATE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADIAX LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE, INCLUDING RELIANCE ON AI-GENERATED BREED/AGE/MOOD ESTIMATES OR VIRTUAL VET GUIDANCE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

9. Indemnification

You agree to indemnify and hold AdiaX LLC harmless from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.

10. Termination

You may stop using PetBet and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service, with notice where reasonably possible.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Puerto Rico and applicable federal laws of the United States, without regard to conflict-of-law principles. Any dispute will be resolved in the courts located in San Juan, Puerto Rico, unless applicable consumer-protection law in your country of residence requires otherwise.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email. Continued use of PetBet after a change takes effect means you accept the revised Terms.
